The need for sharpening the evidentiary techniques employed in Courts with the help of science and technology cannot be denied. At the same time, one has to be conscious of the limitations. The limitations of both science and the law and the need for both to join hands to strengthen the court-systems by legally admissible scientific evidence must be considered.

MEANING AND DEFINITIONS

v SCIENCE

The word “Science” comes from the Latin word scientia, meaning “knowledge” or “knowing”. According to Webster’s New Collegiate Dictionary, the definition of science is “knowledge attained through study or practice,” or “knowledge covering general truths of the operation of general laws, esp. as obtained and tested through scientific method [and] concerned with the physical world.”

In other words, science refers to a system of acquiring knowledge. This system uses observation and experimentation to describe and explain natural phenomena. The term science also refers to the organized body of knowledge that people have gained using that system. Less formally, the word science often describes any systematic field of study or the knowledge gained from it. Perhaps the most general description is that the purpose of science is to produce useful models of reality. Most scientific investigations use some form of the scientific method. Science as defined above is sometimes called pure science to differentiate it from applied science, which is the application of research to human needs. Fields of science are commonly classified along two major lines:

The scientific community that believes that its methods and procedures are above legal scrutiny and questioning often frustrates lawyers. Lawyers and scientists seldom speak the same language. Each should develop a better understanding of the principles and methods of the other”s profession. Bridging the gap between the two cultures is a challenge that this conference seeks to address.

Science and technology seek knowledge through an open-ended search for expanded understanding, whose truths are subject to revision. Law, too, conducts an open-ended search for expanded understanding; however, it demands definite findings of fact at given points in time. The meeting of these two disciplines in the courtroom magnifies the differences between the two cultures. These deliberations of law were co-organised by the Centre for DNA Fingerprinting and Diagnostics (CDFD) and NALSAR University of law. The deliberations brought together the Judges of the Supreme Court and the High Courts, representatives from various Commissions like the Law Commission and the Human Rights Commission, Directors of the National Law Schools and other legal luminaries, lawyers, scientists, doctors, bio-industrialists, NGO”s, police investigators, journalists and a couple of participants from abroad. Inter alia the meeting emphasized the following:

  • To establish a Human Genetics Commission to provide technical and strategic advice about the current and emerging issues in Human Genetics, and a consultative mechanism for development oh National Genetics Policy and guidelines in that area;
  • To establish an Ethics Committee to assess ethical, legal and social issues raised by research on human genome and use of DNA databases;
  • To statutorily define status of human embryo so that research on embryonic cells is done under statutory control and regulations;
  • To devise a mechanism to establish links with the International Community of Dispute for resolution of new issues in new biology;
  • To suitably amend the Patents law to strike a fair balance between public and private interests in case of patents that assert property rights over genetic material.

Cyber crime is a primary example of cross-border crime, and so, it raises the issue of jurisdiction. This is a tricky issue. Acts on the Internet that are legal in the state where they are initiated may be illegal in other states, even though the act is not particularly targeted at that state. Jurisdiction conflicts abound, both negative (no state claims jurisdiction) and positive (several states claim jurisdiction at the same time). Above all, it is unclear just what constitutes jurisdiction: is it the place of the act, the country of residence of the perpetrator, the location of the effect, or the nationality of the owner of the computer that is under attack? Or all of these at once? It turns out that countries think quite differently on this issue. The cyber crime statutes of numerous countries show varying and diverging jurisdiction clauses. Since internet allows transactions between persons of various jurisdictions, an international agreement (to be crystallized into a convention, later) is required for any regulation. However, in arriving at a uniform law, varying standards adopted by jurisdictions across the world and the point of balance adopted by them have to be kept in mind.

Jurisdiction is a highly debatable issue as to the maintainability of any suit that has been filed. Today with the growing arms of cyberspace the territorial boundaries seems to vanish thus the concept of territorial jurisdiction as envisaged under S.16 of C.P.C. and S.2.of the I.P.C. will have to give way to alternative method of dispute resolution.

In addressing the issues of what problems were posed by cyber-crime, Mr. Corell noted that the scope of international cooperation is limited by international agreements and by the national law of the State from which information has been requested. There are also differing priorities between developed and developing countries. These differences complicate international cooperation and expand the gap between the two groups.

There is no authoritative, comprehensive elaboration of the principle of universal jurisdiction concerning cyber-crime, he said. There are different views concerning the offences that constitute crimes under international law that are subject to universal jurisdiction. There are also different opinions with respect to the significance of the obligation to prosecute or extradite, as contained in various treaties, as evidence of universal jurisdiction. Whether States are not only permitted, but also required, to exercise jurisdiction with respect to crimes under international law, is also subject to different opinions.

The s-curve of technological innovation summarizes four major stages in the evolution of a performance characteristic.

1. Emergence – (also known as embryonic stage) shows little improvement in key performance characteristic. Technology operates far below its potential. Neither the characteristics of technology nor its applicability to market needs may be well understood. A long gestation period exists before attempts are made to produce a technology. This new invention period is characterized by a period of slow initial growth. This is the time when experimentation and initial bugs are worked out of the system.

2. Rapid improvement – improves at an accelerating phase. The technology improvement period is characterized by rapid and sustained growth. As organizations engage in production, experience accumulates over time accelerating the improvement in performance characteristic. The technology becomes vulnerable to substitution or obsolescence when a new or better-performing technology emerges.

3. Declining improvement – it declines improvement.

4. Maturity – further improvement becomes very difficult to achieve. The mature technology period starts when the upper limit of the technology is approached and progress in performance slows down. This is when the technology reaches its natural limits as dictated by factors such as physical limits.

During the early phase, a new technology is introduced into the market place but its adoption is limited to a small group of early adopters and small niche markets. As the product gains ascendancy, new capabilities are introduced and refined with the goal of meeting the needs of the broadest possible segment of mainstream users. During this middle phase a dominant design begins to emerge, winning the allegiance of the market place and also effecting standardization of everything from design to manufacturing. The dominant design in turn allows heightened competition as new entrants realize opportunities for further innovation based on cost, scale and product performance.

This is the period of rapid and greatest growth as a technology matures and reaches the mainstream.  During the final phase the product reaches market saturation.

Some examples of technologies that have followed this path can be stated as follows.

The vacuum tube technology was limited by the tube’s size and the power consumption of the heated filament. Both of these factors were natural barriers to electron conduction in a vacuum tube. Electronic engineers could not overcome these limitations. The arrival of the solid-state technology, or transistor, which permitted electron conduction in solid material, changed the physical barriers of size and power. The transistor technology started a new technology life cycle and rendered the vacuum-tube technology obsolete.

Another example is ceramics, which have higher operating temperatures and substitute for metals used in internal combustion engines; the newer technology permits better performance of the engines. The performance of the engines can continue to improve as a result of a sequence of newer technologies, each with a higher limit of the performance parameter of interest.

Often too this is clouded by public policies which as the basis for such oversight are suspect as to which “public” they are intended to benefit. The word “innovate” means to bring in novelties or to make changes. Financial innovation extends this simple definition to the financial world. However, here the simplicity ends with a plethora of products, processes and methods that have been applied to the spectrum of the financial world – some good and some bad.

What drives financial innovation? Simply put – self interest, which finds expression through Adam Smith’s “invisible hand”. Financial institutions seek out, through the innovative process, the most efficient cost effective way to maximise their profits either on existing products or potential new ones.

There are two basic drivers of financial innovation which result from the barriers that a bank faces in reaching its financial goals – competition and regulation. To beat these barriers banks engage in completion of two sorts – competitive or circumventive. The first is pretty obvious as all banks seek to maximise their profits and they do this by competing with other players in the market.

The second, circumventive, is a little bit more obscure. In all jurisdictions financial firms are faced by a plethora of rules and regulations, imposed by the banking and regulatory authorities on how they conduct their business. These are the regulatory barriers that a bank faces. These barriers may often be overcome by innovation – hence the term “circumventive innovation”.

The classic illustration of this is the development of the humble Automated Telling Machine (ATM) which was introduced first in the United States as a circumventive innovation, to get past retractions on branch banking. The idea was quickly picked up, first in Europe, and then globally as a competitive innovation.  European banks had no restrictions on the number ofbranches they could have but labour policies created limitations on for example working hours among many other issues.  In the ATM the European banks found a new “staff member” who (1) was cheaper than a human teller, (2) could work all day and night, (3) was accurate, (4) did not need a physical branch to support it. There were many other plusses a well, not to mention the ability to widely expand the range of products and services that could be offered.

In essence, one type of innovation (circumventive) morphed into another (competitive). This interaction goes on constantly and is a key feature of the dynamics of a constantly evolving financial system. And technology has been a leading driver of this process. We see this in action all the time in many different ways.

Recently I came across a news item that indicated that Citibank had embarked on a project to make deep inroads to consumer banking in India – a vast market. Notwithstanding the size of the market in India, which is on a par with that of China, anyone trying to establish or expand their business in the worlds largest democracy has a massive hurdle to overcome. For a bank one of these hurdles is very tight regulation and the restrictions placed on banks in growing their branch networks.

The Reserve Bank of India, which is the country’s central bank, tightly controls the number of new branch licenses that are granted to foreign banks. This has a massive restrictive affect on the ability of such banks to grow their distribution networks.

To get past this limit on its physical presence Citibank has begun targeting India’s almost six hundred million mobile users. Now this is the “circumventive innovation” that I spoke of.

Citibank, who is one of the leading foreign banks in India with 42 branches and more than 450 ATMs – recently completed a six-month program in Bangalore to test the appetite of customers to make transactions through phones. The program was called the “Tap and Pay” pilot project.

During the project, the bank sold more than 3,000 phones especially enabled to make transactions over the mobile network. Customers made Rs26m (US$585,000) of purchases from 250 merchants. Citibank is now considering rolling out such services to its wider client base.

This case is a classic illustration of how financial innovations can be used an adapted to achieve other needs.

So, what is the message to bank regulators, supervisors and their policy makers? Well put simply “financial innovation or its implications are not always clearly understood”. These facts are critical to bank supervisors and regulators because innovative actions on behalf of the financial industry are not always benign or made for the general good. Equally so, public policy makers need to understand why some financial innovations take place and review their policies in the light of this. Very often restrictive practices are created for the wrong reasons – protection against genuine competition is often disguised as consumer protection.

You will see the message “Software Upgrade” on the screen and “Update” on the player’s LED display. Select “Yes” on the screen and press “Enter.” You will see the message “Loading Software” on the screen and “CHECKSW” on the LED display.
  6. Press “Enter,” open the disc tray, remove the update disc and close the tray when you see the message “New upgrade data verified. Please remove the disc and close the tray to continue.” You will see “Upgrading in Progress” on the screen, and the display will show the percentage of installation completed.
  7. Look for the message “Finished” on the LED display. Unplug the player’s AC cord from the outlet, wait a minimum of 30 seconds and plug the cord back in. Turn the player back on and press “Setup” to confirm that the updated version is shown in the top right-hand corner.
